Terms of Use — Launch

1. Acceptance of Terms

By creating an account or using Launch ("the Service"), you agree to these Terms of Use. If you do not agree, do not use the Service. These terms constitute a binding agreement between you and Launch.

2. Description of Service

Launch is an AI-powered platform that generates marketing plans and publish-ready assets ("Assets") for product launches, selling campaigns, and other marketing initiatives. The Service includes:

Sell path (free): A 2-week tactical plan and listing copy for selling items.
Launch path (paid): A 60-day launch plan (plan unlock: $99) plus individual purchasable Assets ($9–$79 each).

3. Account Registration

You must provide accurate registration information and keep it up to date. You are responsible for maintaining the security of your account credentials. You may not share your account with others. You must be 18 or older to create an account.

4. Payments and Refunds

Plan unlock: The $99 Launch path plan unlock is a one-time, non-refundable fee per launch. You receive a full 60-day plan and access to asset generation in exchange.

Individual assets: Asset purchases are non-refundable once the asset has been generated and delivered.

Exceptions: If a technical error prevents delivery of a purchased item, contact us within 7 days for a full refund of the affected purchase.

Taxes: Prices are exclusive of applicable taxes, which will be added at checkout where required by law.

5. Acceptable Use

You agree not to use Launch to:

Generate fake reviews, testimonials, or ratings for any product or service.
Create spam, unsolicited bulk messages, or deceptive content.
Astroturf communities, manufacture fake social proof, or employ bot-farmed engagement.
Promote illegal products, services, or activities.
Violate any applicable law or regulation, including FTC guidelines on advertising and endorsements.
Infringe on any third party's intellectual property rights.
Attempt to reverse-engineer, scrape, or copy the Service's underlying models or systems.

Violation of these rules may result in immediate account termination without refund.

6. Intellectual Property

Your content: You retain ownership of the product descriptions, brand voice, and other inputs you provide. You grant Launch a limited license to process that content for the purpose of generating your plan and assets.

Generated assets: Upon purchase, you receive a non-exclusive, worldwide, royalty-free license to use the generated Assets for your marketing purposes. You may adapt, publish, and distribute the Assets commercially.

Launch IP: The platform, underlying AI orchestration, research catalog, tactic framework, and all non-generated content are the exclusive property of Launch.

7. Disclaimer of Warranties

Launch is provided "as is" and "as available." We make no warranty that the Service will be uninterrupted, error-free, or that generated plans and assets will achieve any particular marketing result. Marketing outcomes depend on many factors outside our control.

8. Limitation of Liability

To the maximum extent permitted by law, Launch's total liability to you for any claims arising from use of the Service is limited to the amount you paid to Launch in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these terms. On termination, your right to use the Service ends. Purchased assets already delivered remain licensed to you.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in San Francisco County, California.

11. Changes to Terms

We may update these Terms from time to time. The most recent version is always available at this URL. Continued use of the Service after an update constitutes acceptance of the revised Terms.
